Class Agreement

This agreement is made between Canine Behaviour and Fitness (referred to as CB&F) and each dog owner/guardian (referred to as the Client).​

Services: CB&F agrees to provide dog training classes consisting of 4 (four) of 1 (one) hour classes conducted at Blayney Showground NSW.

CB&F will make every reasonable effort to help Client achieve their training goals but makes no guarantee of the dog’s performance or behaviour as a result of participating in the training.​

Cancellation Policy: Any request to cancel a spot in the full training block (four classes), must be made with at least 48 hours' notice. Cancellations made without adequate notice may not be eligible for a refund. CB&F may need to cancel on the day of class, due to weather, therefore will be rescheduled to another date. If the Client cancels a class or is a ‘no show’, the class will not be able to be rescheduled, but a phone call will be offered to provide details on what was missed in that class.​

Termination: At CB&F's sole election, CB&F's duties hereunder shall terminate if Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, CB&F’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

Liability Waiver: I am aware and understand that there is always some unavoidable risk of injury involved when working with animals. I acknowledge the absolute responsibility to follow instructions, standards, guidelines and procedures established by CB&F, its trainers, employee or agents. I am voluntarily registering to participate in CB&F’s dog training services with the knowledge of the risks involved and hereby acknowledge and agree to assume any and all risks of injury, death, and/or property damage, whether caused by the negligence of Amanda Holmes or CB&F, its trainers, employees, or agents, or any other person.​

I hereby agree to forever release, acquit, discharge, and covenant to hold harmless Amanda Holmes and CB&F, its trainers, employees, and agents, from any and all actions, causes of action, and claims on account of, or in any way growing out of, directly or indirectly, all known and unknown personal injuries or property damage which I may have or hereafter have whether attributable to the negligence of Amanda Holmes or CB&F, its trainers, employees, or agents, or any other person.

I agree to indemnify and hold harmless Amanda Holmes and CB&F, its trainers, employees and agents for all costs and expenses which they may incur due to claims or demands alleging such an injury, including settlement payments, court judgments, and legal defence fees.

This Agreement is binding upon Client, spouse of Client, and children of Client. This agreement supersedes all prior discussions, representations, warranties, and agreements of the parties, and expresses the entire agreement between Client and CB&F regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations, or oral understandings have been made with regard to the Client’s dog or anything else. This Agreement may be amended only by a written instrument signed by both Client and CB&F.

Vaccinations: It is not mandatory for the Client to have their dog(s) vaccinated. The premises is a public space, therefore the Client acknowledges they bring their dog(s) at their own risk.

Females on heat: Females on heat are not permitted to attend classes. The above cancellation policy applies.​

Media and photo disclaimer: I hereby consent for CB&F and/or its representatives, agents and related entities to use any photographs, films, videos or recordings of my appearance and my dog for promotional, commercial, and marketing purposes, whether or not accompanied by any narration or dialogue, by any present or future media or means, known or unknown. The same is also agreed to the use of any testimonial given by me.

I acknowledge and agree that CB&F will own any and all rights, title and interest in the photographs, videos, recordings and films and other art-form or material used by CB&F including any intellectual property rights, copyrights or moral rights which may arise from and my dogs participation in the services provided by CB&F.

BY BOOKING THIS SERVICE, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT.
